MUSI3096 Legal Perspective in the Creative Arts (3 units)
This course focuses on legal fundamentals such as intellectual property, misappropriation, copyright, neighbouring rights, moral rights, trade mark rights, publicity rights, passing off, trade secret protection and unfair competition perspectives within the Creative Arts. This course combines academic analysis and case studies to better understand the how law operates and functions in the international perspective in relation to creative ventures. It applies these fundamentals to everyday creative outcomes such as contracting, licensing, joint ventures, examples of contracts in use (such as book publishing music touring, character merchandising) and processes and strategies adopted in negotiation. It will provide students with either a background in law or those from a now-law background but with significant/relevant experience, an understanding of how intellectual property is leveraged and managed for commercial gain in the broader global entertainment and creative industries.
